論我國(guó)執(zhí)行救濟(jì)制度的完善

摘 要

執(zhí)行瑕疵導(dǎo)致執(zhí)行過程中出現(xiàn)執(zhí)行難、執(zhí)行亂的現(xiàn)象，也正是這么1些痼疾的存在，使得當(dāng)事人或第3人需要尋求1種足以保護(hù)其受損權(quán)利的機(jī)制，“沒有救濟(jì)就沒有權(quán)利”。因此，執(zhí)行救濟(jì)應(yīng)運(yùn)而生。本文指出我國(guó)現(xiàn)行法中規(guī)定執(zhí)行救濟(jì)制度存在的嚴(yán)重缺陷，明確公正與效率、分權(quán)與制衡是確立我國(guó)執(zhí)行救濟(jì)制度的基本原則，并在此基礎(chǔ)上，從程序和實(shí)體兩方面對(duì)我國(guó)的執(zhí)行執(zhí)行救濟(jì)制度進(jìn)行完善。

Abstract

The defects of execution cause the phenomenon that the executions are hard to carry out, and the parties or the third party’s right a lot of harm. “No succor, no right .” So, the system of the succor execution occurs. The thesis points out serious defects in the provisions of system of succor execution in current law and makes it clear that the basic principles to the establishment of the system is clean-cut justice and effectiveness as well as decentralization and check and balance. On this foundation, the thesis
designs a system of succor execution on both procedure and entity in China.
